I. Checking and ratifying of the export scale of licensed products

If the products of a newly-established enterprise are subject to export license control, the enterprise shall submit the following documents to Shanghai Foreign Economic Relation & Trade Commission for initial examination, which will send them to the Ministry of Commerce for approval. Upon approval, the enterprise can apply for an export license with an official reply approval from the Ministry of Commerce.

1. Application for the establishment of an enterprise;

2.Project proposal or a feasibility report.

If an enterprise that has been approved to make products not subject to quota and license control is subject to the control due to the state policy adjustment, the enterprise shall apply for initial examination on its export scale to Shanghai Foreign Economic Relation & Trade Commission, which will send its application to the Ministry of Commerce for examination and approval. Upon approval, the enterprise shall apply an export license with an official reply. When applying for checking and ratifying export scale, the enterprise shall provide following documents:

1.Application for export quota and license permit (original copy);

2.Copy of documents of approval on the establishment of an enterprise;

3.Feasibility study report of the enterprise and copies of the contract of joint operation and articles of association;

4.Copies of documents of approval for the establishment of an enterprise and its of business license;

5.Capital verification report

6.Financial audit report of the enterprise  

II.  Annual declaration of export plan concerning licensed products

Necessary documents are as follows:

1.An Enterprise that has been approved by the Ministry of Commerce to export a certain scale of licensed products shall declare the export plan of the next year to Shanghai Foreign Economic Relation & Trade Commission before every October with the following documents.

(1) Application;

(2) An official reply on the export scale issued by the Ministry of Commerce

2. Shanghai Foreign Economic Relation & Trade Commission shall report to Ministry of Commerce after examination and summarization.

3. Shanghai Foreign Economic Relation & Trade Commission shall send the export plan received from the Ministry of Commerce to the applicant. .

4.The applicant shall handle the procedure of applying for an export license with the “Notice”.  

III. Application for exporting precursor chemicals

The following documents are required.

After obtaining a document of approval on an export scale from the Ministry of Commerce, the enterprise shall apply for handling the procedure of export quota and licenses, and such application shall be forwarded to the Ministry of Commerce by competent examination and approval authorities. The documents submitted are as follows.

1.An enterprise’s application for exporting precursor chemicals (original copy);

2. A valid export contract signed between the enterprise and its foreign client (original copy);

3. Documents of approval and certificate of approval for the establishment of an enterprise issued by competent foreign economic & trade authorities, its business license, a contract of joint operation, articles of association, capital verification report.

4. In the event am enterprise applies for exporting products under control, legal and effective import permits issued by the competent authorities of import countries or regions (usually the original of the permit, also the copy of the permit is effective in case of European countries, and the approval letter of Drug Enforcement Agency of the United States shall be provided in case of United States) shall be provided. Where the said products are re-exported through a third country/region, the valid re-export certificate issued by the competent authorities of the third country/region shall be provided, besides all the above documents.
